City Council members this week voted to stand behind the city attorney’s decision to rescind building permits issued to NewPath Networks. The company planned to erect about two-dozen towers.

Not a popular plan with residents like Elaine Fingerette.

“Very narrowly I enjoyed a new sculpture which would have been a 42-foot cell tower right on my front yard. There is no excuse for a company to come in and brazenly do this.”

NewPath attorney Jamie Hall argued the cell towers are exempt from Davis’ city ordinances because they’re a California public utility.

“We do stand ready and willing to work with you. But it doesn’t make any sense and it would be futile to ask us to work through the wireless ordinance process.”

But the city council voted unanimously to rescind the permits.

NewPath officials say they’ll keep trying…and plan to turn in new applications.
