The Secretary of State gave Governor Brown's tax initiative
the top spot after a Sacramento judge ruled that election officials
properly verified signatures for the ballot.
Lawyers for wealthy civil rights attorney Molly Munger had
challenged the law that created the ballot order.
Munger's tax initiative will now be placed eighth on the
list.
But the battle isn't over…the Howard Jarvis Taxpayers
Association has filed its own appeal challenging the law.
The anti-tax group says the ballot positioning legislation is
unconstitutional.
A representative of Governor Brown's tax initiative said the
court rightly rejected what he called a frivolous lawsuit.
